A drunk-driving charge has two parts. In your criminal case, you risk fines and jail time. There is also a driver's license suspension case.

In Missouri, your driver's license is suspended automatically if you are arrested for DWI. You can challenge your driver's license suspension in an administrative hearing, but you have to ask for a hearing, and the time limits are short.

  • If you submitted to a Breathalyzer test at a police station, you have 15 days to request an administrative hearing to challenge the suspension of your driver's license.
  • If you refused the Breathalyzer test, you have 30 days to request an administrative hearing for review to challenge the suspension of your driver's license.

If you do nothing, your driver's license could be suspended for two years or more. For multiple offenses, you may be facing license revocation. These rules are spelled out on Form 2385, which is the white paper included with your summons.
