Understanding What You Face

A third or subsequent DWI conviction is classified as a felony. Missouri judges have a lot of discretion when sentencing people for drunk driving, but in general, the following penalties apply to multiple DWI offenders:

  • Third DUI in 10 years: Class D felony possibly resulting in a fine of up to $5,000; a 10-year revocation of your driver’s license; a prison term of up to five years; no hardship license allowed; ignition interlock device installed on vehicle.
  • Fourth DUI in 10 years: Class C felony possibly resulting in a $5,000 fine; up to seven years in prison; 10-year driver’s license revocation.
  • Five (or more) DUIs: Class B felony possibly resulting in a 15-year prison sentence, with two years mandatory; up to $5,000 in fines; permanent loss of your driver’s license.

Revoked/Suspended License After a Felony DWI Conviction

A felony DWI conviction will result in a 10-year license revocation, no matter how long ago your prior convictions were. During the suspension you are not eligible for a hardship license. Obviously, the lack of a license can greatly disrupt your life and impair your ability to work. The license suspension and criminal penalties combined can be overwhelming.
